1. Agreement to Terms

By accessing or using DigiMark24's website and services, operated by WebGrow LLP, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services.

2. Services Description

DigiMark24 provides digital marketing services including but not limited to:

• Website design and development
• Search Engine Optimization (SEO)
• Social media marketing
• Pay-per-click (PPC) advertising management
• Content marketing and strategy
• Website hosting and maintenance

3. User Responsibilities

You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Use our services only for lawful purposes
• Not interfere with or disrupt our services
• Not attempt to gain unauthorized access to our systems

4. Payment Terms

Payment terms are as follows:

• Prices are quoted in Indian Rupees (INR) or US Dollars (USD)
• 50% advance payment is required to initiate projects
• Remaining 50% is due upon project completion
• Monthly/annual packages are billed in advance
• Late payments may incur additional charges
• All prices are subject to applicable taxes

5. Refund and Cancellation Policy

Refunds are considered on a case-by-case basis. Once work has commenced, advance payments are generally non-refundable. If you wish to cancel a project, please notify us in writing. Completed work will be charged according to our standard rates.

6. Intellectual Property Rights

Upon full payment, you will own all rights to the custom work created specifically for you (website design, content, etc.). However, we retain the right to use the work in our portfolio. Pre-existing intellectual property, tools, and frameworks remain our property or that of our licensors.

7. Service Delivery and Timelines

We strive to meet all agreed-upon deadlines. However, timelines are estimates and may be affected by factors including client responsiveness, scope changes, and unforeseen technical issues. We will communicate any delays promptly.

8. Client Content and Materials

You are responsible for ensuring that all content, images, and materials you provide are legally owned or licensed by you and do not infringe on any third-party rights. You grant us a license to use these materials for the purpose of providing our services.

9. Warranties and Disclaimers

Our services are provided "as is" without warranties of any kind. While we strive for excellence, we do not guarantee:

• Specific search engine rankings or traffic volumes
• Particular business results or revenue increases
• Uninterrupted or error-free service operation
• That defects will be corrected immediately

10. Limitation of Liability

To the maximum extent permitted by law, DigiMark24 and WebGrow LLP shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our total liability shall not exceed the amount paid by you for the specific service giving rise to the claim.

11. Third-Party Services

We may use third-party services (hosting providers, payment processors, etc.) to deliver our services. We are not responsible for the actions, policies, or services of these third parties.

12. Confidentiality

Both parties agree to keep confidential any proprietary information shared during the course of the business relationship. This obligation survives the termination of services.

13. Termination

Either party may terminate services with written notice. Upon termination, you remain responsible for payment of all services rendered up to the termination date. We may suspend or terminate access immediately for violation of these terms.

14. Modifications to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes constitutes acceptance of the modified terms.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Surat, Gujarat, India.
